What happens if the Court does not approve the Proposed Settlement?
The Settlement Agreement terminates and this class action lawsuit continues. The Class Representatives will continue to prosecute the lawsuit. Your legal rights will be affected by the prosecution of this lawsuit, and you have a choice to make now:

By doing nothing, you keep the possibility of getting money or benefits that may come from a trial or the Proposed Settlement. But, you give up any rights to sue Dryvit separately about the same legal claims in this lawsuit.
ASK TO BE EXCLUDED -
Get out of this lawsuit.
Get no benefits from it.
Keep rights.
If you ask to be excluded and the Court either grants final approval to the Proposed Settlement or money is later awarded by jury verdict or settlement, you won’t share in those. But, you keep whatever rights you may have to sue Dryvit separately about the same legal claims in this lawsuit.
